The Delegated Regulations and Implementing Decisions were published in the Official Journal of the European Union
The new Drinking Water Directive (DWD) came into force on 23 January 2021 with its publication in the Official Journal of the European Union. This has been formally transposed into national law in almost all member states in recent years. However, the DWD does not define the minimum hygiene requirements for implementing the testing and certification of products to be imported into the internal market and their conformity assessment.
In order to ensure the harmonized application of the above-mentioned requirements, the Commission has adopted Implementing Decisions to define the specific minimum hygiene requirements. These Implementing Decisions, as well as the Delegated Regulations, were adopted by the European Commission and published on 23.04.2024. The legal framework for a harmonized approach from 01.01.2027 is thus clearly regulated.
The legal acts form the European conformity assessment system and describe how companies must test and certify their products, in order to be able to place them on the internal market. Particular attention should be paid here to implementing decision 2024/368 (testing and accepting final materials) and delegated regulation 2024/370 (Conformity assessment procedure).
